Standard Commercial License

All digital goods available for purchase on Creative Process Collective come with a built in Standard, Non-Exclusive Commercial License. So what does this mean?


to put it simply:


You MAY use our digital resources:

  • For personal projects.

  • In educational materials.

  • Commercial projects for up to 5,000 physical or digital end products for sale.

  • In any number of personal and commercial projects for yourself or a client you are working for.

  • To modify them according to your requirements and include them into works such as printed materials, websites and others.

  • To create digital products for your business, such as opt-in downloads for your audience like e-books, PDFs, worksheets etc. However, templates must be flattened as part of the design (so they can not be extracted).

  • By using copy/text as inspiration to write your blog post/marketing ads about the digital resource, but making sure not to plagiarise or copy word for word.

You may NOT use our digital resources:

  • To Resell, re-distribute, or share as-is or where the template can be extracted as-is (like an editable Indesign or Ps. template).

  • And imply or claim that you are the author of the artwork, even if you have made changes. If you use a template for educational or editorial purposes (print, web or tv) you must include credit (provided below).

  • To sell editable template sites (like Canva, Templett and Corjl) or on print-on-demand sites (Zazzle, Society 6 etc).

  • To allow a client or other user to use items downloaded/purchased from us to make projects for personal or commercial use.

  • To create a derivative digital product to sell/distribute a design which closely resembles the design element downloaded/purchased from us.

  • By copying and plagiarising exact copy/text out into any other derivative forms such as blog posts or marketing ads.

 Editable Templates (Indesign/Illustrator/Photoshop)

Any editable template(s) purchased may not be resold to your audience as a template. Once changes have been made to the template with your own content, branding, colour palette etc, you can then sell that version as an exported, flattened printable (PDF, JPG etc). If you violate this licence and sell our templates within your own store then we will be forced to take legal action.

Attribution/credit

As a CPC customer you do not have to credit/attribute when you purchase and use a template or resource (however if you wish to, we certainly would do a happy dance).

When credit IS required:

All editorial and educational use requires a credit. Credits need to be legible and in close proximity to the resource/template and, where applicable, substantially similar in placement and prominence to other credits.

Limitation of Liability

  • You acknowledge that CPC resources has not been developed to meet your individual requirements, and that it is therefore your responsibility to ensure that the facilities and functions of the resources meet your requirements.

  • You may not use Resource(s) in a manner that is unlawful, harmful, abusive, racially or ethnically offensive, defamatory, deceptive, infringing, invasive of personal privacy or publicity rights, harassing, humiliating to other people (publicly or otherwise), libelous, obscene, threatening, profane, or promotes racism, bigotry, hatred or physical harm of any kind against any group or individual, or is otherwise objectionable.

  • Creative Process Collective will not be liable or responsible for software or platform update, any failure to perform, or delay in performance of, any of our obligations under this Licence that is caused by any act or event beyond my reasonable control, including without limitation failure of public or private telecommunications networks.

  • CPC does not warrant that the operation of the Resources will be uninterrupted or error free.

  • You may not transfer your rights or your obligations under this Licence to another person or business without the express written consent of CPC.

  • Under no circumstances will I be liable to you or any third party for any special, consequential or incidental damages including lost profits, savings or business interruption as a result of the item being defective.


Termination

This license shall automatically be terminated by CPC if you are found to be in violation any of these restrictions.

Upon termination of this license:

  1. you are required to destroy any and all downloaded materials in your possession.

  2. All rights granted to you under this License shall cease.

  3. You must immediately cease all activities authorised by this License.
